Q. What if the property owner cannot use the Investment Tax Credit or accelerated depreciation?
A. We have entities with a “tax appetite” who can partner with a property owner — including nonprofits — to make use of the tax benefits associated with renewable energy systems, and share those benefits with the property owner. Typically, an LLC is created that owns 80% or more of the system (which for these purposes is treated as “separate” from the property), while the property owner retains the right to the energy generated and then to acquire the system after a certain number of years.
